A man who threatened to kill a five-month-old baby has been spared jail after a court heard how a young police officer had accidentally delayed his prosecution.

Odeijran Davids was obsessed with a woman who had become pregnant after they slept together, even though the child was not his but another man's, a judge was told.

The 28-year-old had threatened to kill himself then threatened to kill the pregnant woman and her five-month old child in a terrifying tirade which culminated in him turning up to her home address, the court head.

Nigel Ogborne, prosecuting, said: "The defendant constantly called her, using a withheld number, making threats, saying words to the effect 'I am going to come to your house and I am going to kill your daughter', the victim's five-month-old baby.

"She became angry with the defendant because of the threats he was making, especially to her baby. She states that during that month the defendant called her no less than 50 times.

"She was left feeling harassed and scared. She did not want anything to do with the defendant. She was fearing for her safety and she wanted to make sure the baby was protected from him. She stated it was causing her a great deal of stress, which was no good for her because she was 16 weeks pregnant by this stage."

Despite Davids' obsession, the court heard neither of the victim's children were his and he had been out of contact with her since the incident took place in January 2018.

Davids has previous convictions stretching back to 2010, which included battery, using threatening words or behaviour, possession of a bladed article and possession of cannabis with intent to supply, the prosecutor added.

Defending Davids, who had admitted harassment which put the victim in fear of violence, a lawyer told how he had sickle cell disease and had since found accommodation.

The lawyer said: "He regrets it, he is ashamed. His conduct was unedifying to say the least, appalling or horrible, those type of adjectives properly describe this conduct.

"He feels that his own family would disown him if they realised how bad it was."

Davids, of Farmborough, Netherfield,., appearing at Aylesbury Crown Court for sentence, had not been charged until two years after the offences took place.

This was in part because a young officer had requested complete phone records rather than using a police computer system, the court heard.

Judge Francis Sheridan, sentencing, said: "What you did was utterly horrid, let's not muck about in that regard. If you are a young mum, you are entitled to be left alone, to go on with your life and look after your little baby and not to have some young thug threaten to kill himself and kill you and her baby.

"You were obsessed with this girl and you called her 50 times in one month. It is all bluster and bravado we now know, but I suspect she did not know that at the time."

However, the judge sentenced Davids to a 24-month community order, requiring him to complete a thinking skills programme, 200 hours of unpaid work and pay £150 compensation to the victim.

Explaining the decision, Judge Sheridan said: "I have got to bear in mind that we are talking about events at the end of 2017, going into 2018. There was a delay due to a young officer not understanding what he was being asked for. He could have got it within an hour. Instead, he asked for the full phone records.

"There has been nothing since, because if there had been and you carried on you would be in real trouble. You have kept out of trouble and undertaken courses to make yourself employable.

"You have no reason to make contact with the victim. Do not go near her. You are out of her life, leave it at that.

"Looking at your antecedents, if you come back before the courts, particularly for harassing young women, you are going to go straight to prison."
