Grieving dad refuses to quit fight for justice after the death of his toddler son

Nicholas Harry’s 19-month-old boy Samuel died from a bleed to the brain, which was caused after he sustained a substantial head trauma.

Last year an inquest heard the tot was unlawfully killed and that it is ‘highly likely’ the injuries were inflicted on him.

At the time of the incident in 2013 the toddler was in the care of his mother Deanna Buffham and her former partner Ryan Bate.

The pair blamed each other for the child’s death, and though both were arrested the Crown Prosecution Service concluded there was insufficient 
evidence to bring charges.

Since then Mr Harry, who is head chef for the Compass Group on Kents Hill, has fought to have the case re-examined.

Earlier this year he launched a fund to raise £100,000 for a private prosecution of Miss Buffham and Mr Bate.

But now he has been told by one of the country’s leading barristers that, though his story is tragic, his bid has ‘little chance for success’ without additional evidence.

The heartbroken dad is now refunding donations to his campaign.

But Mr Harry, who has a Facebook page called Justice for Sam, is determined not to give up.

“This is not the end of the fight, it is a set back, but not the end,” he said.

“We will never give up on my beautiful little angel.”

His colleagues at the Compass group still mark Sam’s birthday every year by going to Willen Lake and releasing balloons in the tot’s memory.
